This Agreement of Waiver and Liability ("Agreement") is entered into between The Holding Space, located at 304 Main St Avon by the Sea, NJ, hereinafter referred to as the "Studio," and the undersigned participant, hereinafter referred to as the "Participant."

1. Assumption of Risk: Participant acknowledges that participating in yoga classes, workshops, and activities involves inherent risks, including but not limited to physical exertion, flexibility, and balance exercises. Participant voluntarily assumes all such risks and acknowledges that participation is of their own free will.

2. Physical Health: Participant represents that they are in good physical condition and have no medical condition that would prevent their full participation in yoga classes, workshops, and activities. Participant agrees to inform the Studio of any health concerns or changes before participating.

3. Release and Waiver: In consideration of being allowed to participate in yoga classes and activities, Participant hereby releases, waives, discharges, and holds harmless the Studio, its owners, instructors, employees, and agents from any and all liability, claims, demands, actions, or rights of action, whether personal to Participant or to a third party, arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant or property belonging to Participant, whether caused by negligence or otherwise.

4. Photography and Likeness: Participant grants the Studio the right to use photographs, videos, or likenesses of Participant for marketing and promotional purposes, without compensation.

5. Personal Property: Participant understands and agrees that any personal belongings brought to the Studio are their responsibility, and the Studio shall not be liable for any loss, damage, or theft of such belongings.

6. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of New Jersey, without regard to its conflict of law principles.

7. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, and understandings, whether written or oral.

By signing this document, I acknowledge the inherent risks and voluntarily assume full responsibility for any injury, damage, or loss that may result from my participation. I hereby waive and release the business, its owners, and its staff from any and all liability, past, present, and future, relating to the services provided.
